Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the SellByte website, checkout, accounts, and related support channels (together, the “Services”). By browsing, creating an account, or placing an order on sellbyte.in, you agree to these Terms.

If you do not agree, do not use the Services. Please also read our Privacy Policy and Refund Policy, which form part of your overall agreement with us.

1. Who we are

SellByte operates an online storefront for physical goods in India. We currently deliver only within India, and all prices are in Indian Rupees (₹ INR). For questions about these Terms, email support@sellbyte.in or use the Contact page.

2. Eligibility

You must be at least 18 years old, or use the Services with the consent and supervision of a parent or legal guardian who accepts these Terms on your behalf. You confirm that the information you provide is accurate and that you are legally able to enter into a purchase.

3. Accounts and guest checkout

You may shop as a guest when guest checkout is enabled, or create an account to track orders, invoices, and addresses. You are responsible for keeping login details confidential and for activity under your account. We may suspend or close accounts that appear abusive, fraudulent, or in breach of these Terms.

If email verification is enabled, some account features may stay limited until you verify your email address.

4. Physical products and shipping

SellByte sells physical goods. After payment (or COD acceptance) we fulfil from our warehouse or through a dropship supplier. Courier delivery times are estimates, not guaranteed service-level contracts.

Product pages show whether an item is fulfilled from our India warehouse or a dropship supplier, expected dispatch days, and courier estimates for India delivery.

You must provide an accurate India shipping address and 6-digit PIN code. We are not responsible for delays or RTO caused by incorrect address details, a refused delivery, or an unavailable recipient.

5. Pricing, taxes, coupons, and availability

Prices are displayed in Indian Rupees (₹ INR) and listed GST-exclusive unless stated otherwise. GST is calculated at checkout. We may change prices, discounts, flash sales, and stock at any time before you complete payment. An order is not confirmed until payment is successfully captured (or COD is accepted) and the order is marked in our system.

Coupons are subject to their own rules (minimum order value, first-order only, excluded products, expiry, one coupon per order, etc.). We may cancel a coupon discount if it was applied in error or obtained through abuse.

If a listed product becomes unavailable after payment, we will attempt to offer a suitable replacement or a refund according to the Refund Policy.

6. Payments

Payments are online at checkout through the payment providers enabled in store settings, Cash on Delivery for eligible India orders, or offline via WhatsApp ordering when that option is turned on.

You authorise the selected payment method to charge the order total, including shipping and GST. Online payment providers have their own terms. SellByte does not store full card numbers on its servers.

Orders placed via WhatsApp (offline) may not create an automatic site order until we confirm the order with you.

7. Order acceptance, cancellation, and fraud review

We may refuse, cancel, or delay any order if we reasonably suspect fraud, chargeback abuse, stolen payment instruments, or other misuse.

If we cancel before dispatch, we will refund eligible captured payments through the original method where possible. If fulfilment has already started or the courier has the parcel, cancellation is handled under the Refund Policy.

8. Acceptable use

You agree not to:

• use the site to commit fraud, money laundering, or unauthorised card use;
• attempt to break into accounts, scrape the site aggressively, or disrupt our systems;
• harass staff or other customers;
• submit false dispute claims or chargebacks without first contacting support with a genuine issue.

We may block IP addresses, payment methods, phone numbers, or accounts involved in abuse.

9. Intellectual property

The SellByte name, storefront design, product copy, graphics, and software we publish are protected. You may not copy the site, clone listings at scale, or use our branding without permission. Third-party marks remain the property of their owners.

10. Support

Support is provided on a commercially reasonable basis via email, contact form, and WhatsApp when enabled. We aim to reply within a few hours on Indian business days, but response times are not guaranteed. Keep your order number ready.

11. Refunds

Refund eligibility for physical goods, RTO, and damaged parcels is described in the Refund Policy. Opening a payment dispute or chargeback without contacting us first may delay resolution and can lead to account limits.

12. Disclaimer of warranties

Except as expressly stated, the Services and products are provided on an “as available” basis. We do not warrant uninterrupted uptime or that courier partners will meet a specific delivery date. To the maximum extent permitted by law, implied warranties are excluded.

13. Limitation of liability

To the maximum extent permitted by applicable Indian law, SellByte and its operators will not be liable for indirect, incidental, special, consequential, or punitive losses, including lost profits, lost data, or business interruption.

Our total liability for a claim relating to an order will not exceed the amount you paid to SellByte for that order, except where liability cannot be limited by law (for example, fraud or certain consumer rights that cannot be waived).

14. Indemnity

You agree to indemnify and hold harmless SellByte from claims arising out of your misuse of the Services, your breach of these Terms, or inaccurate shipping details you submitted.

15. Governing law and disputes

These Terms are governed by the laws of India. Courts in India shall have jurisdiction, subject to any non-waivable consumer protections that apply to you. Before filing a formal dispute, you agree to contact support@sellbyte.in and allow a reasonable time for us to investigate.

16. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date will change when we do. Continued use of the site after an update means you accept the revised Terms for future visits and orders. Material changes may also be highlighted on the site when practical.
